Terms of service

These terms govern the use of the DUNEFORMA portal and retouching service by real-estate agencies and their staff ("you"). The service is provided by DUNEFORMA ("we"), based in Dubai, United Arab Emirates. By creating an account or uploading photos you accept these terms on behalf of your agency.

1. The service

• You upload property photographs; we retouch them (exposure, colour, white balance, removal of temporary clutter) and deliver them through the portal for your review.
• Retouching uses AI image models following a professional retouching method, and every AI result is compared with your original and rejected automatically if it is not recognisably the same frame (a coarse match). Colour checks and a changed-areas map are then shown on each photo so you can judge it; they flag, they do not block. If the first result is rejected, one second try is made on the same photo, which can double its cost. Retouching includes smoothing accidental creases in bedding and covers, shaping the existing light locally, restraining floor reflections, removing cranes, scaffolding and parked cars from views, balancing window views, and, if you switch them on, straightening (which trims the edges) and blurring faces and number plates. We do not add, remove or alter permanent features of a property (rooms, walls, windows, fixtures, views) unless you ask in writing and it is lawful to do so.
• Turnaround times shown in the portal are estimates, not guarantees.

2. Your responsibilities

• You confirm you have the right to upload each photo (from the photographer and, where needed, the property owner) and to have it edited.
• You are responsible for how the delivered photos are used in advertising, including any disclosure that photos were digitally edited and compliance with the rules of the Dubai Land Department / RERA and the listing portals you use.
• Do not upload photos showing identifiable people who have not agreed, or anything unlawful.
• Keep your sign-in email secure. Activity under your account is your responsibility.

3. Ownership and licence

• You (or the photographer) keep all rights in the original photos. You give us a limited licence to store, process and edit them only to provide the service.
• The delivered retouched photos may be used by you without restriction for marketing the property.
• We will not use your photos in our own marketing without your written permission.

4. Commercial terms

• Fees, volumes and payment terms are set in your company's written agreement with us.
• We may pause access in line with that agreement.

5. Quality and redo

If a delivered photo does not meet the brief, request changes in the portal within 14 days and we will redo it at no charge. This is your main remedy for quality issues.

6. Liability

• The service is provided with reasonable skill and care. Except where the law does not allow it, our total liability for any claim is limited to the fees you paid for the affected photos in the three months before the claim.
• We are not liable for indirect losses, lost sales or commissions.

7. Data and retention

How we handle personal data is described in our Privacy notice. By default we delete the original photos you upload 90 days after a shoot is settled (every photo delivered or approved, and nothing changed on it since). Retouched photos you received stay available in the portal while your account is open, and we delete them when you ask. Please keep your own copies.

8. Suspension and closure

We may suspend accounts that misuse the service or breach these terms. You may close your account at any time by contacting us at decastrojohn001@duneforma.com.

9. Changes

We may update these terms; we will tell you in the portal or by email before material changes take effect.

10. Law and disputes

These terms are governed by the laws of the Emirate of Dubai and the federal laws of the UAE. Disputes go to the courts of Dubai.
